To obtain permission for special water use

Permission for special water use is issued by the State company of water resources of Ukraine at the local level. In accordance to the law of Ukraine «On modifications for certain legislative acts of Ukraine, which regulate relationships related with obtaining documents of permissible character in regard to special water use» modifications were put for special water use of secondary water users. As a reminder, that the secondary water users are the business entities which don’t have their own water abstraction constructions and use constructions of other enterprises for water supply and/or water discharge by right of agreement of water supply (water discharge). From now, the secondary water users have to obtain permission for special water use as the primary water users.

For obtaining permission for special water use, the business entity has to prepare and provide the following compulsory documents:

• Scheme and description of the territory of water abstraction and wastewater discharge;
• Justification the water needs including a calculation for each month of water use and water discharge;
• Calculations of maximum permissible discharge (MPD) of pollutant substances into water objects including backwater;
• Public utility services and business entities which provides services of centralized water supply and/or water discharge have to provide approved individual needs in potable water use;
• Copies of the entitling documents of water bodies.

The limits for water abstraction, water use and water discharge are pointed in permission for special water use. The issue of permits for special water use takes to 30 days from providing documents for permission and corresponding application. In case of using the underground waters, local authority of State company of water resources of Ukraine sends the copies of provided docume3nts to the central authority of executive power in the field of geological exploration and rational use of mineral resources. If the business entity uses the treating water bodies, local authority of State company of water resources of Ukraine directs the documents to the central authority of executive power that provides and realizes a state policy in the field of health protection.

The main reasons for refuse in obtaining permission for special water use can be: providing of incomplete package of documents; the presence or identifying during review of provided documents the false information or one that does not meet the legislative requirements; obtaining a negative conclusion from the executive authorities in the field of geological exploration, mineral resources using and health protection.

The new law prescribes the reasons for reissue of permissions for special water use, these are: change the name and location of business entity (legal entity or sole proprietor). For reissue of permission it required to provide the current permission and application for reissue. The term for the reissue of permit for special water use is 2 days from providing the corresponding application. In case of loss or damage of current permission for special water use, the business entity can obtain its duplicate during 2 days of submit the corresponding application.
