Environmental impact assessment as a part of project documentation in accordance with the State constrcution codes

Environmental impact assessment as a part of project documentation in accordance with the State constrcution codes is directed on identification and prognosis of character and rate of dangerous from any economic or industrial activity on human health and environment conditions. The conduction of evaluation of impact on environment of any future activity allows in the process of activity performing, making managerial decisions related with possible negative impact on environment.

In addition, the materials of evaluation of impact on environment are prepared for conducting state environmental expertise. Although, these materials are called in common way and evaluate the same impact, but the structure of EIE materials for comprehensive evaluation of impact and environmental expertise are different.

The principles and methodology of EIE were approved by almost all world countries. The guideline of European Union №337/85 «Evaluation of impact of certain state and private projects of economic activity on environment» concentrates on compulsory conducting of evaluation of impact on environment for obtaining corresponding permit on performing activity that can cause negative ecological consequences on environment.

On the territory of Ukraine, the challenge for EIE implementation was an approval of following legislative documents: the law of Ukraine «On environmental expertise», «On nature environmental protection» and State construction norms А.2.2-1-95 «Composition and content of evaluation of impact on environment (EIE) during projecting and construction of enterprise, buildings».

The main aim of EIE implementation means avoidance of dangerous impact on the status of ecological systems, natural resources and human health during economic activity and other types of entrepreneurship. In other words, the project of EIE prescribes the prognosis of possible risks and losses for environment at the beginning of projecting. It allows to evaluate negative impact and in advance to develop the complex of measures for their minimization or full elimination. The article 15 of the law of Ukraine «On environmental expertise» prescribes the compulsory development of general evaluation of activity`s impact, which is planned or that have already conducted on environmental conditions. In addition, it is necessary to include information about which natural resources will be used and which measures are suitable for their reproduction. All the above mentioned is prepared in form of separate chapter and claim on possible ecological consequences from economic or other types of activity.

In case, if there are impacts on environment conditions from economic activity for neighboring states, so it is necessary to prepare trans-boundary EIE. The order and regime of trans-boundary EIE is developed due to Convention on EIE in trans-boundary specification.

In the process of evaluation of impact on environment are involved three sides: customer, contractor and society. The customer`s obligations are preparation of all materials and documents of planned activity according to requirements to type of activity, which is planned to perform. The contractor conducts all necessary measures for EIE due to established norms and standards in the sphere of ecology. In addition, contractor is responsible for authenticity of information in materials of EIE. The third party in EIE conduction is society. During environmental expertise due to Ukrainian legislation, it is compulsory to inform people about performed activity of enterprise and about possible negative ecological consequences from it. If required, there are held public hearings and discussions to explain ecological and biological aspects of planned activity and possible impact on environment and their health.

International organization of impact evaluation on environment in its methodology defines the followings stages of EIE: screening (defines the necessity of project evaluation as possible source of impact on environment), scoping (identifies problems and sources of negative impact on environment) and evaluation of impact (defines and prescribes the level of social and ecological impact on environment). At last stage there are held qualitative calculations of impact: duration (month, quarter, year), periodicity (single, permanent), intensity (quantity of pollutants on time unit) and capacity (quantity of pollutants on area unit).
