To obtain permission for mineral resources using

Permission for mineral resources using is a document allowing mineral resources using, conducting geological explorations and commercial and research developments of mineral resources deposits, underground waters, constructing and using underground constructions for storage of oil and gas, and, actually, conducting oil and gas mining. Mineral resources using in Ukraine and an issue of the special permissions for mineral resources using is carried out by the Public service of geology and mineral resources of Ukraine (Derzhheonadra) through two ways. The first case means the issue of permission for mineral resources using without holding auction due to the requirements of «Order for special permissions for mineral resources using», from 30th of May 2011 №615. In other case the business entities can obtain permission according to the procedure of auction trading due to the «Order for holding an auction of trading special permissions for mineral resources using» approved by the Act of Cabinet Ministers of Ukraine №594 from 30th of May 2011.

If the business entity obtains permission for mineral resources using on standard terms (without holding auction), it is necessary to prepare and provide the following documents:

1. explanatory note for justifying the aims of business entity for mineral resources using;
2. copies of passport and identification number;
3. authenticated copy of permission for special water use (only for deposits of underground water);
4. laboratory researches results of particular type of mineral resources and underground waters;
5. characteristics of land plot;
6. geographical coordinates and maps;
7. geological and hydrological maps (only for deposits of underground waters) and schemes of cross sections;
8. action plan at land plot;
9. agreements on terms for mineral resources using.

The business entity can obtain one permission for one type of mineral resources using within particular land plot. But, if business entity mines mineral resources of one type from a few deposits located close to each other and if the rationality of combined work is approved by decision of State Commission for mineral resources reserves, so he can obtain one permission for one type of mineral resources for few deposits. Within one deposit can be geological exploration and mineral resources mining of various types by several permissions.

Special water use of underground water objects is a mineral resources using. But in accordance to part 1 article 22 of Code of mineral resources of Ukraine, land users and land owners within their land plots have a right without patented mining claim and special permissions to conduct mineral resources mining of local importance and peat with total depth of two meters’ developments, and also underground waters mining (except mineral) for all needs, except packed potable water production, but if the volume of underground water mining from each water abstraction is not over 300 cubic meters per day. That`s why, if business entity uses the underground waters in the volume more than 300 cubic meters per day for industrial, production needs and packed potable water production (regardless of the daily volume), he is obligated to obtain the permission for special water use and permission for mineral resources using.
